Kenya’s Court Temporarily Halts Recruitment of KCAA Director General

A Milimani High Court has issued a temporary conservatory order blocking the recruitment and appointment of the Director General of the Kenya Civil Aviation Authority (KCAA).
The order follows a petition filed by Humphrey Bulimu, who seeks multiple reliefs and argues that the KCAA board’s resolution to advertise, commence, and carry out a competitive recruitment process for the position is unlawful and unconstitutional.
In issuing the interim order on June 3, 2026, Justice Roselyne Aburili noted that the petitioner had successfully persuaded the court of the need to preserve the process; otherwise, his application and petition would be rendered nugatory once the recruitment exercise concluded.
Judge Aburili stated that even if the recruitment process were completed and an appointment made amidst the alleged illegalities—though potentially reversible if found to violate the law—it would come at a high cost to the public purse and cause reputational damage to a public entity in the aviation industry.
“For the foregoing reasons, I hereby grant a temporary conservatory order staying the already commenced process of recruitment and appointment of the Director General of the Kenya Civil Aviation Authority by the 1st respondent’s board until the application for conservatory orders is heard and determined,” Judge Aburili ruled.
