KCAA and Aviation Union Begin CBA Talks, Hit Early Stalemate on Membership Definition

The Kenya Civil Aviation Authority (KCAA) has confirmed the commencement of Collective Bargaining Agreement (CBA) negotiations with the Kenya Aviation Workers Union (KAWU), though the first meeting concluded with a fundamental disagreement.

In a statement released yesterday, the Authority detailed that the initial negotiation session was held on 20th January 2026. KCAA expressed its commitment to “good faith” and “constructive” engagement on the standard agenda of a CBA.

However, discussions encountered an immediate hurdle regarding the definition of “unionisable grades”—which employees are legally eligible for union representation. KCAA management stated its position is bound by a prior ruling from the Industrial Court (Cause No. 35 of 2011), which it says legally establishes the eligible grades.

“Management reiterated its position, which is guided by an existing determination of the Industrial Court,” the statement from Director General Emile N. Arao read. “This ruling… continues to govern the Authority’s position on this matter.”

Despite this sticking point, KCAA indicated its readiness to proceed with negotiations on all other pertinent issues. The meeting adjourned without resolution on the membership definition, leaving a key procedural matter unresolved for future sessions.

The Authority sought to reassure the public and aviation stakeholders, emphasizing that its primary focus remains uninterrupted service and safety.

“KCAA remains committed to lawful, constructive, and good-faith engagement with KAWU,” the statement continued, expressing confidence that “outstanding issues can be addressed through structured dialogue.”

The Authority further affirmed its dedication to “service continuity, aviation safety, and the public interest, while upholding employees’ rights and fulfilling its statutory mandate.”

The early deadlock highlights a potential complex path ahead for the negotiations. Both parties are expected to reconvene as they seek a path forward within the framework of Kenyan labour laws and the existing legal precedent cited by the Authority.
